included in the Plan, UNLESS the entity is legally constrained from implementing a particular <br />water conser~~ation element, such as water reuse. <br />The planning elements defined in the statute are very basic and broad in nature, and according to <br />the best available water conser~~ation planning science and policy, espoused by other western <br />states and the American Water Works Association, provide the critical foundation for the success <br />of any Water Conser~~ation Plan. <br />The DNR Executive Director's Office presented this Legislative Initiative Concept to the <br />Governor's Office. The Governor's office concurred with the concept and requested that the <br />proposed statutory change be reflected in the CWCB's 2008 Construction Fund Projects Bill. <br />On October 31, 2007, staff presented this proposed statutory change to the Colorado General <br />Assembly's Interim ~Uater Resources Review Committee. <br />The proposed statutory change would be included in the 2008 Construction Fund Projects Bill as <br />follows: <br />SECTION XX. §37-60-126 Colorado Revised Statutes, is amended to read: <br />37-60-126.Water conservation and drought mitigation planning -programs -relationship <br />to state assistance for water facilities -guidelines -water efficiency grant program - <br />re eal. <br />(4) A plan developed by a covered entity pursuant to subsection (2) of this section shall, at a <br />minimum, include the following plan elements: oe~eted: ~ons~a~ <br />Recommendation <br />Approve the staff recommendation regarding the inclusion of statutory changes in the 2008 <br />Construction Fund Projects Bill to achieve the Board's intent. The staff has the authorization to <br />work with the Executive Director's Office, the Governor's Office, and members of the General <br />Assembly regarding the specific language. The staff shall have the authorization to recommend <br />the deletion of such statutory changes from the bill if their inclusion endangers the bill's final <br />passage. The staff shall keep Board members informed regarding the progress of discussions <br />regarding the proposed statutory change. <br />
