Section 2 <br />Statewide Demographic, Economic, and Social Setting <br />amounts or loads of specific pollutants that the impaired <br />water body can receive from each identified source <br />without exceeding the standards set for that water body. <br />The TMDL must include a margin of safety, waste load <br />allocation (for point sources), and a load allocation (for <br />non-point sources and natural background). Once a <br />TMDL is established, it is implemented through the <br />state's point and non-point source water quality control <br />programs. <br />WQCC Regulation 93 documents the state's 303(d) list of <br />impaired waters that are targeted for TMDL <br />development. Regulation 94 establishes the "Monitoring <br />and Evaluation List" that contains a separate list of water <br />bodies that are suspected of having water quality <br />problems, but there is insufficient data to determine <br />whether the water bodies are impaired. Water bodies on <br />the Regulation 94 list are the focus of additional <br />monitoring to determine whether they should be placed <br />on the state 303(d) list. <br />Colorado's proposed 2004 303(d) list, which was <br />submitted to EPA in March 2004 for review and approval, <br />includes water quality-impaired stream segments in each <br />of the state's eight major river basins. Impairments for <br />various stream segments throughout the state are based <br />on diverse parameters that include but are not limited to <br />metals, bacteria, nitrates, pH, dissolved oxygen, and <br />sediment. In July 2004, EPA found that the state's 2004 <br />list only partially met the requirements of Section 303(d) <br />of the CWA. While EPA agreed that the water bodies on <br />the state's proposed list were impaired, EPA found that <br />the state should have included six additional water <br />bodies on its 303(d) list.
