The source of the water is: Maggie Gulch, tributary to the Animas River <br /> <br />4. Legal description of the stream segment through which an instream flow is claimed <br /> <br />a. The natural stream channel from the headwate~ of Maggie Gulch at <br />latitude 370 48' 19" N and longitude 1070 32' 31" W as the upstream <br />terminus and extending to the confluence of the Animas River at <br />latitude 370 51' J 8" N and longitude t 070 34' 35" W as the <br />downstream terminus, being a distance of approximately 4.7 miles. <br />This segment can be located on the Howardsville U .S.G.S. <br />quadrangles. <br />b. For administrative purposes only: <br />UpperTerminus=SW~SW~~SWlA Section 16, T41N R6W NMPM <br />637 feet from South section line. 0 feet from West section line of said <br />Section 16. <br />UTM 4J87249N 276215E, NAO 83, Zone 13 <br />Lower Terminus;;;;; SE y.;SW~ NWy.; Section 31. T42N R6W NMPM <br />297 feet from North section line, 664 feet from the West section line <br />of said Section 31. <br />UTM 4192871N 273379E, NAD 83, Zone 13 <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25,2005. <br /> <br />7, The water was first applied to the above beneficial use on January 25,2005. <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />9 ~ 37-92-102(3) and 37-92-103(3). (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of2.5 cfs (May I - <br />Oct. 31) and 1.5 cfs (Nov. 1 - Apr. 30). <br /> <br />RULING AND DECREE OF THE WATER COURT: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 2.5 efs <br />(May I - Oct. 31) and 1.5 efs (Nov. 1 - Apr. 30) is hereby entered to preserve the natural <br />environment to a reasonable degree through the stream segment described in paragraph 4 <br />above. The appropriation date for this water right is January 25, 2005. <br />
