<br />Vaughn: It's all in Dan's head right now. Weare going to have to get legislation passed that <br />would allow us with our construction fund, give authority to make all of these expenditures and <br />the intent is we can then recoup the funds from the water users. Otherwise, we would be in fiscal <br />rule violation by signing a contract for two $40 million contracts where the money has not been <br />appropriated for that. We have to get this done now so it's available for FY2009. <br /> <br />Rick: This is a process parallel to the rest of our committee meeting, we want you to come back <br />every month and tell us what is going and share drafts of contracts. <br /> <br />Vaughn: The one reason I haven't made it to this meeting, I have a standing Tuesday afternoon <br />staff meeting, and asked to change this... happy to come in and if I can come in at 1 :30 I can <br />come in and do this. Hasn't been very quick progress in the past with the contracting... <br /> <br />Rick: When you get these examples, you can pull a bunch oflanguage together, I'd like if the <br />contract between the Corps and the CWCB, and the contract between CWCB and the entities, so <br />we could see how it all works and the relationships. <br /> <br />Vaughn: Ifwe were to negotiate a contract with the Corps, and then you say this doesn't work <br />for us, that's a waste of time, so want to move forward simultaneously. I don't know whose <br />Corps person will be doing the contracting. <br /> <br />Sandy: Whether Omaha district or headquarters, I don't know. <br /> <br />Vaughn: Eric said he was going to be getting me sample contracts, don't want to leapfrog him, <br />so that sums up the contracting part of it, and not having written the agenda today, any other <br />items that other people had? Anyone want to talk about DC trip? <br /> <br />Jim Dorsel(?): ER item - Tracy? Knowledge of issues on ER. We learned on Friday about how <br />the Corps wants to have a letter report to incorporate into the EIS. How does that description of <br />the ER benefits if they are described, how is that going to relate to any credit we get down the <br />road if the ER effort regains steam? <br /> <br />Sandy: That's a separate issue, there was discussion on separating the two issues. Unless they <br />made another statement that led you to believe... <br /> <br />Rick: The two of them saying that there is part of the ER work we need for the EIS. It's their <br />own idea of what they need and when they need it, <br /> <br />Jim (?): Don't want this to cut into any future promises or cost efforts down the road. Ifwe <br />revisit this issue down the road, is there going to be another EIS requirement to incorporate that? <br />How would that be handled? That's something we talked about before but we never got a <br />resolution.
