Ms. Stengel, I am not in a position financially to fight the State of Colorado and can not
spend any more money trying to do so. My position is that the lower reach of the Alder Creek
filing should end at my western property line. I object to the reach crossing into my
private property. There is a historical diversion point at my western property line that I
claim is valid and senior to this proposed filing. This can be confirmed by the water
commissioner Art Rivale. Also, Craig Cotton found an ancient diversion point belonging to me
that is a half mile upstream from my property. I will close permanently that diversion point
if the State will stop the reach of their filing at my property line. I believe this is fair
to both parties. I will be asking Travis Smith, as my representative on the Water Board, to

I am the attorney representing the CWCB in the Alder Creek instream flow application. I
contacted your former attorney, David M. Shohet, who informed me that he was no longer
representing you. I need to discuss this case with you because it is now set for a hearing in
November but the prehearing statements and conferences are coming up in the near future. Mr.
Shohet told me that he would inform you of these deadlines but I wanted to inquire as to
whether you would be submitting a prehearing statement next Tuesday, July 17th. There is also
a prehearing conference call on July 24th. </DIV>
