<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />C.21 COPYRIGHTS <br /> <br />C.21.1 For recipients subject to the administrative standards set forth in OMB Circular <br />A-110, the following copyright provision, as implemented by 43 CFR 12.936(a), shall <br />apply: <br /> <br />"The recipient may copyright any work that is subject to copyright and was <br />developed, or for which ownership was purchased, under an award. The <br />Federal awarding agency(ies) reserves a royalty-free, nonexclusive and <br />irrevocable right to reproduce, publish, or otherwise use the work for <br />Federal purposes, and to authorize others to do so." <br /> <br />C.21.2 For recipients subject to the administrative standards set forth in OMB Circular <br />A-102 and the Grants Management Common Rule, the following copyright provision, as <br />implemented by 43 CFR 12.74, shall apply: <br /> <br />liThe Federal awarding agency reserves a royalty-free, nonexclusive, and <br />irrevocable license to reproduce, publish or otherwise use, and to authorize <br />others to use, for Federal Government purposes: <br /> <br />(a) The copyright in any work developed under a grant, subgrant, or <br />contract under a grant or subgrant; and <br /> <br />(b) Any rights of copyright to which a grantee, subgrantee or a contractor <br />purchases ownership with grant support." <br /> <br />C.22 RIGHTS TO DATA <br /> <br />For recipients subject to the administrative standards set forth in OMB Circular A-110, <br />the following provision, as implemented by 43 CFR 12.936(c), shall apply: <br /> <br />"The Federal Government has the right to: <br /> <br />(1) Obtain, reproduce, publish or otherwise use the data first produced <br />under an award; and <br />(2) Authorize others to receive, reproduce, publish, or otherwise use <br />such data for Federal purposes." <br /> <br />C.23 USE AND DISCLOSURE OF PROPOSAL INFORMATION--DEPARTMENT OF <br />THE INTERIOR (APR 1984) <br /> <br />26 <br />
