PLANNING <br /> <br />IaJ 002 <br /> <br />Exa.rnrt e <br /> <br />- <br /> <br />LETTER AGREEMENT <br />BETWEEN <br />THE U. S. ARMY CORPS OF ENGINEERS <br />AND <br />THE STATE OF NEBRASKA, DEPARTMENT OF ROADS <br /> <br />THIS AGREEMENT, entered into this _ of 2000, by and between the United States <br />of America (hereinafter called the "Government"), represented by the Contracting Officer <br />executing this Agreement, and the State of Nebraska, Department of Roads (hereinafter called <br />the "Sponsor"). <br /> <br />WITNESSETH THAT <br /> <br />WHEREAS, Section 206 of the Flood Control Act of 1960 (74 Stat. 500; 33 U. S. C. 709a) <br />authorizes the Secretary ofthe Army, acting through the Chief of Engineers, to compile and <br />disseminate information on floods and flood damages on behalf of the Federal and non-Federal <br />interests; and I <br />I <br />WHEREAS, Section 321 of the Water Resources Development Act of \990 (Pub. L. 101-640) <br />authorizes the Secretary of the Army to collect from Federal agencies ~d private persons fees <br />for the purpose ofrecovering the cost of providing services pursuant to fection 206; and <br /> <br />WHEREAS, Section 202 of the Water Resources Development Act of i999 amends the Flood <br />Plain Management Services Program authority to allow for voluntary c~ntributions by States, <br />local governments, and Indian Tribes for the purposes of obtaining sen1ces under the program; <br />and" ! <br />I <br /> <br />WHEREAS, the Sponsor has identified the "need for flood plain managdment services as <br />described in the Scope of Services incorporated into this agreement; an~ " <br /> <br />WHEREAS, the Sponsor has the authority and capability to furnish the~ooperation hereinafter <br />set forth and is willing to provide the payment for the services in accor: ance with the terms of <br />this agreement; <br />I <br />NOW THEREFORE, the parties agree to the following: I <br /> <br />I. The Government, using funds contributed by the Sponsor, shall exp~ditiously prosecute and <br />complete the services, currently estimated to be completed within approlximately 120 days of the <br />Sponsor providing the required survey information in compliance with the Scope of Work <br />attached as Enclosure 1 and in conforriuty with applicable Federallawsr Id regulations and <br />mutually acceptable standards and engineering practice. <br /> <br />2. The sponsor shall pay in cash 100 percent of the total cost of services, which is currently <br />I <br />estimated to be $35,685. Both parties understand that funding must be received prior to <br />acconlplishing the work for which that funding is intended. <br /> <br />
