<br />. . <br />I.' <br />.'- ..... \l,:. <br />'. <br /> <br />COP\- <br /> <br />01 Pb~ atrJ6 3 <br /> <br />Reference Information: <br />City of Greeley, Colorado <br />Cache La Poudre River Floodplain Study <br />March 2001 <br />$19.920 <br /> <br />LETTER AGREEMENT <br /> <br />BETWEEN <br /> <br />THE U.S. ARMY CORPS OF ENGINEERS <br /> <br />AND <br /> <br />THE STATE OF COLORADO <br /> <br />This Agreement, made this 27 day of February 2001, by and between the United <br />States of America (hereinafter referred to as the "Government") represented by the Contracting <br />Officer executing this Agreement, and the State of Colorado for the use and benefit of the <br />Department of Natural Resources, Colorado Water Conservation Board, (hereinafter referred to as <br />the "Sponsor"). <br /> <br />WITNESSETH, that: <br /> <br />WHEREAS, Section 206 of the Flood Control Act of 1960 (33 U.S.C. s709a) authorizes the <br />Secretary of the Army, acting through the Chief of Engineers, to compile and disseminate <br />information on floods and flood damages on behalf of Federal and non-Federal interests <br />(hereinafter referred to as the "Flood Plain Management Services Program"); and <br /> <br />WHEREAS, Section 321 of the Water Resources Development Act of 1990 (p.L. 101-640) <br />authorizes the Secretary of the Army to collect from Federal agencies and private persons fees for <br />the purpose of recovering the cost of providing service pursuant to section 206; and <br /> <br />WHEREAS, Section 202 of the Water Resources Development Act of 1999 authorizes the <br />Secretary ofthe Army to accept funds voluntarily contributed by State, regional, local governments <br />or other non-Federal public agencies for the purpose of expanding the scope of the services of <br />obtaining such services; and <br /> <br />WHEREAS, in 1998, the Government completed a Technical Assistance Study for the City of <br />Greeley and Weld County, Colorado, under the Flood Plain Management Services Program. The <br />study was conducted in response to a request from the Colorado Water Conservation Board and <br />was 100% Government funded; and <br /> <br />WHEREAS, the Sponsor has identified the need for additional Flood Plain Management <br />Services, as a result of the previous study, and as described in the Scope of Service incorporated <br />into this Agreement (hereinafter referred to as the "Study"); and <br /> <br />WHEREAS, the Sponsor's authority exists in the law, and funds have been budgeted, appropriated <br />and otherwise made available and a sufficient unencumbered balance thereof remains available for <br />payment by the Sponsor in Fund Number 100 , Organization 5500 , Appropriation <br />PDI, GBL FMOO , Program 'f!RC , Object Code _, Reporting Category <br />,Agreement Encumbrance Number e..r53OJ/(p; and <br />I 1 <br />
