<br />D~T-16-9a FRI 11:04 UPPER COLORADO RIVER COMM <br />0002;~7 <br /> <br />P.06 <br /> <br />Six State Proposal <br />Straw Man Draft <br />October 13, 1998 <br /> <br />S) The United States and the Colorado River Basin States must commit to ongoing <br /> <br />studies and analysis to examine whether the interim ~operating criteria are causing an <br /> <br />increased risk of water shortages to Arizona and Nevada.!:>,) A~. <br /> <br />6) California must agree to mitigate any increased risk of shortage to Arizona and <br />Nevada or other risk placed on the Upper Basin ,tate, caused by ~g criteria. That <br />mitigation might be accomplished either through waiver by California of the shortage protection <br /> <br />it is afforded by 43 U.S.C. ~ lS21(b), or by California agreeing to store in Arizona through the <br /> <br />Arizona Water Banking Authority water that could be used to compensate Arizona and Nevada <br /> <br />. '. ""'~ <br />for increased water shortages they suffer due to the,fperating criteria, or through other measures. <br /> <br />~t~ <br />7) Operating criteria that would provide extra municipal and industrial water for <br /> <br />California during that state's transition period must be designed to provide only that amount of <br /> <br />water that is needed by California M&I users after all other sources available to the state have <br /> <br />been used. <br /> <br />While MWD holds California priority 4 and 5 rights to a total of 1.212 mat~ there have <br /> <br />been many years when their actual need for water has been considerably less. At the recent <br /> <br />meeting of the Basin State representatives in San Diego, MWD's Director of Operations, <br /> <br />indicated that the actual firm need for water may be about I maf. Therefore, it should nQ1 be <br /> <br />assumed as a starting point that MWD's Colorado River water demands exceed 1 maf/annum. <br /> <br /> <br />Ex.tra water not directly related to spill avoidance or flood control release criteria should not be -11 <br /> <br />used to make water available for groundwater storage or for use in the future to fill or refill the <br />, <br /> <br />5 <br />
