<br />... <br /> <br />00J249 <br /> <br />Six State Proposal <br />Straw Man Draft <br />Includes Fassett and Mutz comments <br />11/4/98 <br /> <br />Likewise, to the extent that unused Arizona or Nevada basic apportionment can be made <br />l( <br />available to California users under the provisions of Article7(B)6 of the Decree, that water mmt <br /> <br />also must be counted against MWD's needs prior to determining the volume ofneed for any <br /> <br />sUlplus water derived under the interim criteria. <br /> <br />In other words, water made available from the interim surplus criteria must be the only- <br /> <br />remaining source of water available to avert municipal and industrial water shortages in Southern <br /> <br />California. The interim criteria cannot be designed to allow California to divert Colorado River <br /> <br />water that is needed only because it is a less expensive source of water than other supplies <br /> <br />available within California. The Six States are also unwilling to accept interim operating criteria <br /> <br />which provide additional water to Southern California in order that environmental issues <br /> <br />elsewhere in California can be addressed. <br /> <br />8) To the extent that these interim criteria operate to provide extra water to municipal <br /> <br />and industrial water users in Southern California, municipal and industrial water users in the other <br /> <br />Lower Division States must be afforded the same opportunity, within the allocations defined by <br /> <br />municipal and industrial water users in Nevada and Arizona would also be entitled to water above <br />\ <br /> <br /> <br />1 <br /> <br />the Law of the River. For example, if the Secretary declares a surplus, it must be recognized that <br /> <br />the state's basic apportionment to meet their needs. <br /> <br />9) The Six States are well aware that the revised 4.4 Plan calls for a considerable <br /> <br />amount of groundwater banking within California at sites in the Cadiz Basin, Hayfield/Chuckwalla <br /> <br />Basin, and Desert/Coachella Basin.
