White <br />Mail Staff Writer <br /> <br />The Upper Arkansas River flow could be harmed by a proposed memorandum of <br />understanding regarding the Chaffee County recreational in channel diversion water <br />right filing. <br /> <br />Upper Arkansas Water Conservancy District board members discussed the matter <br />during their regular meeting Thursday. <br /> <br />Water lawyer Julianne Wold ridge spoke about a proposed memorandum of <br />understanding among water users involved in the recreational filing. <br /> <br />"The memo proposal is causing grave concern for (engineer) Ivan (Walter), (!~eneral <br />manager) Terry (Scanga) and I with respects to the district's interests," she said. <br /> <br />"It appears the negotiation has wording where some senior exchangers would not <br />(exchange water) during certain times to not interfere with the RICO, but would <br />move their exchanges to times it would bump junior water exchangers," she said. <br /> <br />Walter, who participated in the meeting via telephone, said exchanging water at <br />alternate times could pull more water from the river than if exchange periods were <br />unchanged. <br /> <br />"When they postpone the exchange during high flows into periods of low flows, it'll <br />increase the river losses," Walter said. <br /> <br />Scanga said he believes the memorandum would benefit large exchangers such as <br />Aurora, Colorado Springs or Pueblo. <br /> <br />"I don't think this (memorandum) wipes out our negotiations with Chaffee County. I <br />think we need to discuss this with Chaffee County, because I believe the board of <br />commissioners would side with us once they really understand this issue. I dlon't <br />think they understand it now. It's injurious." <br /> <br />In other business, directors discussed a petition for inclusion into the district by <br />citizens of eastern Fremont County and related legal issues..' <br />
