<br /> <br /> <br />Southeastern Water Rights <br /> <br />. Southeastern has a 1939 water right for Pueblo Reservoir which <br />includes the right to exchange measured municipal Fry-Ark return <br />flows. <br />· This decree allows entities that purchase Fryingpan-Arkansas (Fry- <br />Ark) Project Water from Southeastern to purchase and exchange <br />measured municipal return flows from their system to Pueblo <br />Reservoir. Many of these entities also have other water rights that <br />they would like to exchange into Pueblo Reservoir. The exchange of <br />non-project waters would be junior to Pueblo's RICD and the <br />municipalities would be limited by the RICD decree. <br />. Southeastern has a'contractual obligation to beneficially use Fry-Ark <br />project water and Fry-Ark return flows within Southeastern's service <br />area. In 2001, Southeastern filed a Water Rights application to <br />exchange unmeasured municipal and agricultural Fry-Ark return flows <br />from below Pueblo Reservoir to help meet this obligation. These <br />exchanges will allow for the allocation of this water for well <br />augmentation and other uses. <br /> <br />Southeastern also serves small communities in the <br />Arkansas Valley <br /> <br />· Many of the partners in the PSOP are small rural water <br />providers. These rural communities in the upper and lower <br />Arkansas valley need re-operations and enlargement as much <br />as or more than the larger cities. <br />· These entities do not have the financial resources to develop <br />storage by themselves and working with the larger cities <br />makes the PSOP a viable option for them. <br /> <br />29 <br />
