<br />WHEREAS, previous floodplain information consists of detailed information that has <br />become outdated; and <br /> <br />FLOODPLAIN IN FORMA TION TO BE DESIGNATED <br /> <br />WHEREAS, Moser & Associates Engineering completed a new report entitled "Flood <br />Hazard Area Delineation, Murphy Creek" dated August, 2006; and <br /> <br />WHEREAS, said new report contains detailed floodplain and flood way infonnation for <br />Murphy Creek from just downstream of Highway 6 to just north of Smoky Hill Road through the <br />City of Aurora (City) and Arapahoe County (County); and <br /> <br />WHEREAS, said new report contains detailed floodplain and floodway information through <br />the City and County for Tributary 2000 from the confluence with Murphy Creek to Mississippi <br />A venue; Tributary 3000W from the confluence with Murphy Creek to just upstream of Jewell <br />Avenue; Tributary 3000E from the confluence to Jewell Avenue; Tributary 4000W from the <br />confluence with Murphy Creek to a point 5,743 feet upstream; Tributary 4000E from the <br />confluence with Murphy Creek to Yale A venue; and Tributary 7000 from the confluence with <br />Murphy Creek to a point 3,013 feet upstream; and <br /> <br />LOCAL REQUEST FOR DESIGNATION <br /> <br />WHEREAS, the study resulting in the said new report was prepared to provide local <br />jurisdictions with a basis for managing Murphy Creek, and tributaries, floodplains and floodways and <br />to minimize threats from flooding to public health and safety; and <br /> <br />WHEREAS, the Urban Drainage and Flood Control District transmitted a letter dated October <br />30, 2006, to the CWCB requesting designation and approval of said new study for Murphy Creek; and <br /> <br />WHEREAS, the Urban Drainage and Flood Control District Board of Directors also passed a <br />resolution at their October 19,2006 meeting to adopt the subject study; and <br /> <br />C.R.S. AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(l)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />2 <br />
