<br />Sijou Irrigation District <br />September 18-19, 2007 <br /> <br />Agenda Item 18a <br /> <br />Intake Canal, which is in good condition, and 2) the river diversion structure, used to divert flow <br />into the ditch intake structure, which is in need of significant repairs. The diversion structure has <br />suffered extreme damage in times of high flow in the river. It currently uses a removable board <br />system to control water levels in the river, and the structure has lost its effectiveness due to large <br />sand build-up on the upstream side. The current structure cannot be operated in a manner to <br />reduce the sand upstream of the intake gates, causing excessive sand to be drawn into the intake <br />canal, and hampering diversions into the intake. The existing diversion also has a problem with <br />debris, mainly trees getting hung up, and requires continual maintenance. The proposed project <br />would make repairs to the river diversion portion of the structure by constructing a 100 foot long <br />Obermeyer Pneumatic Spillway Gate (Bladder Gate), located immediately adjacent to the ditch <br />intake structure. <br /> <br />Feasibilitv Studies <br /> <br />Nation Engineering Services, LLC, of Fort Morgan, has completed the feasibility study in <br />accordance with CWCB guidelines. The study includes an assessment of alternatives for <br />rehabilitation of the District's diversion structure/headgate. <br /> <br />Bijou IrriQation District <br /> <br />The District was formed in 1905 by resolution of the Morgan County Commissioners and operates <br />as an Irrigation District under the Irrigation District Law of 1905 (C.R.S. 37-41-101 to 160), including <br />amendments in C.R.S. 37-43-101 to 211. The District office is located in Fort Morgan. The Morgan <br />County Treasurer serves as the ex officio District Treasurer and collects and distributes <br />assessments, in the same manner as property taxes are collected. Money is distributed to the <br />District on a monthly basis. Affairs of the District are governed by a 5-member Board of Directors. <br />Three Directors are from geographic divisions, and two serve at-large. Officers are Donald Neb, <br />President, Larry Krening, Vice-President, and remaining Directors are Doug Dill, Mike Groves and <br />Mike Kosman. The Superintendent is Mike Wagner and the Secretary/Office Manager is Denice <br />Wagner. Typically, about 65% of the District budget comes from acreage assessment revenues, <br />25% from boating/recreation leases, and 10% from other sources. The District opens the reservoir <br />to multiple boating clubs that provide a source of revenue in the form of permit fees. In 2006, <br />operating revenues for District, not including CWCB loan proceeds for the Empire Reservoir <br />spillway project, were $355,000. <br /> <br />Following adoption of a budget resolution in October, the District certifies the required levy of <br />assessment to the Morgan County Commissioners, with copies to the State Treasurer and <br />Department of Local Affairs. State revenue laws pertaining to the assessment, levying, and <br />collection of property taxes (including enforcement of penalties and forfeiture for delinquent taxes) <br />are applicable to the District. The District may also refuse delivery of water to lands until all past <br />due or delinquent assessments have been paid in full. (C.R.S 37-43-143.) Because this loan <br />contract exceeds $400,000, the Irrigation District Law of 1905 requires the District to hold a special <br />election of the legal electors in the District to authorize and ratify the contract. C.R.S.37-41-113(4). <br />The election must follow the same procedures that the district would follow to authorize the <br />issuance of a bond.
