a leadership position when and if this Program is established. It should also give the State a head stmi in
implementing federally required procedures in the future.

Conclusion
A levee policy for Board consideration is attached. The primary purpose of this levee policy is to state the
position that levees should be used as structures of last resOlt and only after other measures, especially
nonstmctural ones, have been fully considered. Levees should not be used as a means to facilitate the
development of currently undeveloped flood prone lands. Staff has communicated with Jack Byers of the
Division of Water Resources (Dam Safety Progrmn) regarding this issue, and intends to fully coordinate mld
cooperate with DWR with respect to all statewide levee issues.

The focus of the comments received at the July 2007 Board Meeting dealt with how to address existing
levees within the policy statement. The policy was modified to include strong language encouraging proper
maintenance of levees already constmcted that protect existing structures. In addition, the issue of potential
liability was addressed as a fUlther memlS of discouraging new levees.

Staff Recommendation
Comments mld feedback received from the July 2007 Board Meeting were incorporated into the proposed
levee policy. Staff recommends that the Board approve the attached CWCB levee policy.

Attachment: CWCB Statewide Levee Policy

Flood Protection. Water Project Planning and Finance.
