It should also give the State a head stmi in <br />implementing federally required procedures in the future. <br /> <br />Conclusion <br />A levee policy for Board consideration is attached. The primary purpose of this levee policy is to state the <br />position that levees should be used as structures of last resOlt and only after other measures, especially <br />nonstmctural ones, have been fully considered. Levees should not be used as a means to facilitate the <br />development of currently undeveloped flood prone lands. Staff has communicated with Jack Byers of the <br />Division of Water Resources (Dam Safety Progrmn) regarding this issue, and intends to fully coordinate mld <br />cooperate with DWR with respect to all statewide levee issues. <br /> <br />The focus of the comments received at the July 2007 Board Meeting dealt with how to address existing <br />levees within the policy statement. The policy was modified to include strong language encouraging proper <br />maintenance of levees already constmcted that protect existing structures. In addition, the issue of potential <br />liability was addressed as a fUlther memlS of discouraging new levees. <br /> <br />Staff Recommendation <br />Comments mld feedback received from the July 2007 Board Meeting were incorporated into the proposed <br />levee policy.
