Pursuant to Rule 5k of the Rules Concerning the Colorado Instrcam Flow and Natural Lake Level Program of the Colorado Water
Cooservation Board (CWCB), the Moffat County Commissioners submit this Notice to Contest the InSlTCam Flow (ISF)
Appropriation on Willow Creek, MotTat County, Water Division 6. We provide the following inlormation in accordance with Rule
5K(2):

Item 19 Irom July II'" CWCB Meeting -New Appropriations- Willow Creek in Moffat County. The CWCB declared its
intent to appropriate an Instream Flow on Willow Creek in July 2007.
c) Contested facts and general description of data;
Moffat County disputes the flow data supplied to the CWCB by their staff and dOll't agree flows recolllmended for a new
water right exists, The impact on existing water rights as well as future water rights. and the lack of ability for an instream
flow appropriation to atlcct the natural environment arc of concern. Moffat County may rcly upon biological, hydrological,
and economic data to refute evidence presented.
