Sherman Executive Director FROM: Jeff Baessler Owen Williams Dan McAuliffe Acting Director DATE: September 5, 2007 SUBJECT: Agenda Item 15, September 18-19,2007- Board Meeting Stream and Lake Protection - 2007 Instream Flow Appropriations Contested Instream Flow Recommendations-Water Division 6, Moffat County This memo provides a listing of the Contested Streams and Contested Parties/Participants. The Notices to Contest are attached to this memo. Participants As per Rule 5d. (3)(d)., the following Instream Flow Recommendation was contested by the listed parties by the August 15,2007 deadline of the modified schedule: Willow Creek Moffat County Commissioners Staff notified all persons on the ISF Subscription Mailing List of the contested recommendation prior to the August, 20 deadline of the modified schedule. Pursuant to Rule 51.(4), where a contested ISF appropriation is based fully or in part on another agency's recommendation pursuant to Rule 5a., that agency shall automatically be a Party in any proceeding. Based on Rule 51.(4), the US Department of the Interior, Bureau of Land Management will be a party to the contested stream proceedings. The following members of the public have requested Contested Hearing Participant Status in accordance with Rule 5m.(1) of the Instream Flow Rules.
