Water deliveries through the NGWSP may only <br />occur upon completion (?fa Programmatic Biological Opinion or other mechanism under <br />the San Juan River RecovelY Implementation Program that protects all existing water <br />uses in the basin and provides for the./lfture developmellf (?f 60,000 AF qfnew uses in <br />the basin, which can be equitably divide among the states within the San Juan River <br />Basin. <br /> <br />We would note for the record that the State of Colorado agreed to support the <br />Hydrologic Determination as did the Upper Colorado River Commission (June 5, 2007 <br />resolution) premised on these understandings. Subsequently, on May 23,2007 Secretary <br />of Interior Kempthorne approved the 2007 Hydrologic Determination required by law to <br />contract for water out of Navaj 0 Reservoir. <br /> <br />In closing, Colorado is in support of the passage of S. 1171 under these <br />conditions. We have attached several copies of correspondence hereto for your <br />information. Please contact us should you have any questions concerning Colorado's <br />positions on S.117l.
