<br />Consent Agenda Item l.e <br />Case No. 5-07CW128 <br />Application of Ranch at Roaring Fork Home Owners Ass'n and Richard J. and Shirley M. Hunt <br /> <br />Application Summary <br /> <br />This is an application for surface and storage water rights, a change of water right, and approval of a <br />plan for augmentation for the Ranch at Roaring Fork Development near Carbondale in Garfield <br />County. Applicants seek the following: <br /> <br />1. Water rights for ponds and streams with an appropriation date of January 10, 1996. The <br />claimed amount is 100 acre-feet. Application does not specify if the rights sought are <br />conditional or absolute. <br />2. Change of water right for the Patterson Ditch. The Ditch historically ilTigated the land <br />currently developed. While the proposed change is not clear in the application, it appears <br />the water and historic consumptive use credits will be used to fill the pond and for <br />augmentation of evaporative losses. <br />3. Approval of a plan for augmentation to replace out-of-priority depletions associated with <br />evaporative losses from the ponds and streams. The sources of augmentation are dry-up <br />irrigation consumptive use credits and releases from Green Mountain and Ruedi Reservoir <br />under a contract with the Basalt Water Conservancy District. <br /> <br />CWCB Appropriation <br /> <br />The CWCB has appropriated the following instream flow water right that could be injured by this <br />application: <br /> <br />CWCB Stream/Lake Amount Approp. Watershed County <br />Case No. ( cfs ) Date <br />5-85CW639 Roaring Fork River 6/1.5 11/27/90 Roaring Fork Garfield <br /> <br />Potential for Iniurv <br /> <br />The Applicants' proposed plan for augmentation may injure the Board's instream flow water rights <br />on the Roaring Fork River by not replacing out-of-priority depletions in time, place and amount. <br />The Applicants' proposed change of water right may result in an expansion of use that could injure <br />the Board's instream flow water rights on the Roaring Fork River. <br /> <br />Other Obiectors <br /> <br />The State and Division Engineers and Twin Lakes Reservoir and Canal Company also filed <br />statements of opposition to this application. <br />
