<br />. <br /> <br />. <br /> <br />. <br /> <br />Western States Water Council <br />Water QualityCommittee <br /> <br />Washington, DC <br />March 13, 2007 <br /> <br />Good news is that we understand where the real rubs are, we are committed to outcomes and <br />getting decisions made, and EPA is going to the Water Director level (rather than regions). <br /> <br />Joan said she thought the paper was very good and very useful, recognizing it is just a draft. She <br />expressed appreciation to EP A. Paul agreed saying trying to get some answers to questions where there <br />is quite a bit of confusion is very helpful. <br /> <br />Denise said this wi\1likely be considered new policy, and therefore wi\1 go through "Good <br />Guidance" review by OMB. <br /> <br />Bonnie mentioned a 20-year old EPA document on this issue. She will make it available to <br />Shaun to distribute. <br /> <br />GOOD SAMARITAN - Brent Fewell and Lynn Buell <br /> <br />Brent thanked WSWC for all of their work on Good Sam. <br /> <br />On the legislative front, there is the WGA strawman. EP A is still discussing whether to have <br />their bill reintroduced. Are sensitive to time constraints and effort to get broad support. If they do seek <br />reintroduction, it will not be to undermine WGA's effort. <br /> <br />Have almost perfected their templative Administrative Order on Consent. Have gone from 65 <br />pages down to 13. Process needs to be streamlined. <br /> <br />Will roll it out the end of March. <br /> <br />IfWGA bill gains steam, there will need to be some protection under CERCLA. EPA looking <br />at Administrative authorities they can provide to that end. <br /> <br />EP A met with DOJ to let them know their work on this, and that they are getting ready to come <br />out with new AOC. <br /> <br />1 07( d) comfort letter is the approach. <br /> <br />Template is designed for Hard Rock, but is not limited to expanding to other cleanups. Don't <br />know yet how this will be transmitted. Will want to bring in stakeholders (including WGA) to comment <br />on it. Want state participation when AOCs are signed. <br /> <br />Joan commented thatthe states should have the same kind of coordination between water quality <br />and waste programs as EP A has done in developing this draft. <br /> <br />5 <br />
