Bryan Howard, Rep. Udall-Given that we have ability to move forward on a number of
CW A sites, and given Sen. Boxer's comments, we need to be pragmatic.

.

Jon Pallow-He needs to make recommendations to his boss. Should there be CW A
and/or CERCLA? Pragmatism vs. Ideology. Do we need to take actions to clean up or
not? Brownfields was successful.

Standard

Cathy Carlson-the Remediation Plan will really drive the standard. It essentially
becomes the standard.

Joan Card-true. The objective is to have an open process, and try to get agreement on
the front end of the process.

Michael Gianotto- Will send language.

Joe Pizarchik-This strawman language gets to the heart of the problem from PA's
experience. It addresses both limited resources and what is technologically achievable.
Needs to be on a case~by-case basis. Science needs to drive as much as resources.

Velma Smith-The John Salazar bill had more meat to it on this issue. Can't make the
site worse. Should work in watershed context. States could focus on priority watersheds
identified after public comment.

.

Steve Quarles-l)"reasonable certainty": don't like this language. What is Unreasonable
certainty?
2) Real problem is strawman needs to allow someone to survey. Need rulemaking
authority for streamlined permit for surveying. Will send us language.

Velma Smith-suggested tying the idea of setting priorities to allowing investigative
sampling.

Definition of Good Samaritan

Velma Smith-Need another level of criteria. Definition of "inactive or abandoned
mine": Shouldn't allow mining companies with liability elsewhere to be good sams.
Need language that would preclude anyone with a cleanup or enforcement action.

Marcelle Shoop, Rio Tinto-If it is an administrative order, and the mining company is
in compliance, they would be precluded under Velma's language. Why should they be?

Joe Pizarchik-P A has experience with this under their program. They use "satisfactory
progress" language from coal. He will send us this language.

Michael Gianotto- There are violations. And then there are Violations!

.

4
