We understand the loan will be used to <br />rehabilitate to Company's diversion structure on Fountain Creek. <br /> <br />The Board recommended a loan from the Construction Fund in a maximum amount of <br />$250,000 with terms of 4% for 30 years. I have attached a copy of the updated Board <br />memo concerning the Chilcott Ditch Company. Please refer to page 3 of that memo and <br />to the section "Action taken by the CWCB November 23, 1999." <br /> <br />When the Board recommends an Emergency Construction Fund Loan there remain <br />several conditions: <br /> <br />a) A Feasibility Study must be completed. John Van Sciver of our staff will draft the <br />study, and send you a copy for review and comment. The study will then be finalized <br />by December 31, 1999 in accordance with the requirements of the CWCB <br />Construction Fund Guidelines for feasibility studies. <br /> <br />b) An approved contract must be in place before funds can be advanced. Jan IlIian will <br />contact you concerning our contracting procedure. It usually takes about 2 months to <br />complete the contract after the loan has been approved by the CWCB. <br /> <br />c) You must adhere to the CWCB Desiqn and Construction Administration Procedures. <br />Tim Feehan will contact you regarding the CWCB requirements concerning design <br />and bidding of the construction project. Tim will make construction inspections, which <br />will be the basis of the monthly pay estimates for disbursement of your loan funds. <br />
