We should change the laws so that <br />it is closer to a desired outcome. Western law presumes there will be shortage. In the East, they <br />presume there will always be plenty of water. That difference alone is the reason that ASIWPCA <br />can not meet the needs ofthe West. The goal of the Council has been to figure out a way to achieve <br />a better outcome than the Eastern approach. (The Bear River Commission has added water quality, <br />and it is a. good model of coordination.) ASIWPCA members are not appointed by the governors. <br />WSWC representatives are appointed by the Governors which also raises the clout of the Council. <br /> <br />Paul Frohardt said he agrees with both Karl and Joan's comments. The reality is that the <br />majority of WQ management challenges do not have the quality-quantity interaction. He senses a <br />couple of concerns of how things are working: 1) we don't have a critical mass of water quality <br />administrators from western states participating on the Council; 2) we have not had adequate time <br />for discussion ofWQ issues at the meetings; 3) the rest of the meeting does not speak to the majority <br />ofWQ interests. Paul F. suggested: 1) we schedule one WSWC meeting without a WQ meeting, <br />and 2) we schedule a WQ meeting at an ASWIPCA meeting. The objective would be to get a <br />broader r'epresentation of WQ member participation. <br /> <br />Karl Dreher said he thinks Paul's suggestion is good, but premature. He suspects that the <br />reason there is not good participation is that the Governors think their WQ members are <br />participating. We should first tell the governors that they need to direct their WQ appointees to start <br />attending. Regarding scheduling, nothing prevents a committee from having meetings between <br />Council meetings. Karl stressed that ASIWPCA does not consider quantity issues - the Council <br />wants the: WQ folks to take into consideration quantity. <br /> <br />Walt Baker said that other states feel they are getting more bang for the buck from <br />ASIWPCA. He suggested that we have more conference calls between meetings to discuss and <br />prepare for different issues. <br /> <br />The Committee agreed to proceed with the following steps forward: 1) have a sidebar <br />meeting of western states at an upcoming ASIWPCA meeting; and 2) work to identify the WQ <br />representatives for the Council from each state. If we do not have the right person named to the <br />Council, let's make sure to get the right person. <br /> <br />Tom Stiles agreed to the steps forward, but noted he does not want the Council to be seen <br />as competing with ASIWPCA. <br /> <br />EPA ISSUES (continued) <br /> <br />9th Circuit Decision on NPDES <br /> <br />. Joan Card said her first issue on the job was this issue. Arizona is asking the Court to rehear <br />the case. Does EP A have authority under the CW A when they delegate to states?
