EVERIST, INC. <br />PAGE 4 <br /> <br />Existing land uses surrounding the property are typically agricultural and rural <br />residential in use. Additionally, there are four County-permitted sand and <br />gravel mines, in addition to the applicant's Fort Lupton Sand and Gravel <br />facility located within two miles of the amendment area. Weld County has <br />two facility's located to the north - Koenig and Bearson mines; and the Heit <br />Mine and NCCl's Zadel Mine are located to the south. The proposed mining <br />and reclamation plans for water storage have been designed to be <br />compatible with the existing surrounding and approved future land uses. <br /> <br />State Highway 85 is approximately 0.5 mile to the east. Little Dry Creek <br />traverses the western edge of the amendment site, the Lupton Bottom Ditch <br />bisects the amendment and existing mine site, and the South Platte River <br />serves as the eastern property extent. The City of Fort Lupton is within the <br />three-mile referral area and Is approximately 0.5 miles to the south of the <br />permit area. The amendment and existing site are outside of the <br />Intergovernmental Agreement Area as evidenced by the Notice of Inquiry <br />form submitted with this application. <br /> <br />The City of Fort Lupton, in a letter dated October6,2004, stated thatthe Fort <br />Lupton Planning Commission was to review this case on October 12,2004, <br />at 7:00 p.m. Staff received the October 12, 2004, Meeting Minutes which <br />state "... we have reviewed the request and find no conflicts with our <br />interest... . <br /> <br />The Department of Planning Services believes that, with the endorsement <br />of the Conditions of Approval contained in this recommendation, the approval <br />ofthis use will not jeopardize the health, safety, or welfare of the surrounding <br />property owners. <br /> <br />e. Section 23-2-230.8.5 - The application complies with Section 23-5-200 of <br />the Weld County Code. The proposal is located within the Flood Hazard <br />Overlay District area, as delineated on FIRM Community Panel Map <br />#080266-0868C, dated September 28, 1982. The applicant will be required <br />to amend its existing Flood Hazard Development Permit #355 to address the <br />proposed uses associated with this amendment. <br /> <br />f. Section 23-2-230.8.6 -- The applicant has demonstrated a diligent effort to <br />conserve prime agricultural/and in the locational decision for the proposed <br />use. The parcel is designated as "Other. and "Irrigated land (Not Prime)". <br />No lands associated with this amendment are identified as "Prime" <br />agricultural land, Much of the property is located within the 100 year <br />noodplain. thus limiting the agricultural productiveness of the site. The area <br />has historically been utilized as pastureland. <br /> <br />g.
