During the winter, water would be released from storage
and the Board would protect that flow through the ISF reach. During both summer and winter
periods, the agreement provides for reduced releases during emergencies, shortages or
projected shortages, but also establishes a minimum release of 5 cfs during those times.

Winter Months (October 1-Mav 9)

The Donation Agreement focuses on three distinct hydrologic scenarios tied to winter storage
levels in Vallecito Reservoir. Under each winter scenario, PRID and the Tribe have committed
to donate a specified amount of stored water to the Board to preserve the natural environment
to a reasonable degree in the Pine River downstream from Vallecito Reservoir. During the
summer months, the instream flow reach would extend from the outlet of the reservoir to the
Highway 160 Bridge; during the winter months, the reach would extend further downstream to
the confluence of Dry Creek near the town of Ignacio.

DOW Recommendations

Preserve: DOW has recommended instream flows of 136 cfs during the summer months and
75 cfs during the winter months to preserve the natural environment to a reasonable degree. To
address differences between the amount of water recommended by the DOWas necessary to
preserve the natural environment during the winter, and the flow amounts which may be
available under the Donation Agreement, the parties have also included a provision for the
purchase or lease of water, if physically and legally available, for instream flow use.

Improve: Additionally, DOW has recommended the following flow amounts to improve the
natural environment to a reasonable degree:

. May 1-May 31: flows from 136 cfs to a maximum of 360 cfs. The CDOW believes flow
amounts in this range would improve the natural environment to a reasonable degree by
providing optimum to outstanding habitat.

. June 1-June 14: flows from 136 cfs to a maximum of 720 cfs. The CDOW believes
flows up to 720 cfs would improve the natural environment to a reasonable degree by
providing flushing flows.

Flood Protection' Water Project Planning and Finance.
