<br />requirements; contracts for domestic and other water; contracts for power plant operations; <br />other contracts; weather forecasts; anticipated Tribal water needs; and other pertinent <br />information. Projections shall be updated as often as necessary, which, in some situations, <br />may be as often as weekly. <br /> <br />2.J. Senior Water - Water that flows through Vallecito for the benefit of water rights senior <br />to, and downstream from, the Vallecito water rights. Senior Water is not considered Donated <br />Water, nor is it charged by the CDWR against the fill of Vallecito. <br /> <br />2.K. Shortage- <br /> <br />a. A Shortage in the Summer Months is defined as (1) when Projections indicate <br />that Vallecito will not physically fill to 95,000 AF during the water year or, (2) Vallecito <br />has failed to achieve a physical fill of 100,000 AF during the water year, unless <br />Projections indicate that Vallecito will physically fill to 95,000 AF or more. <br /> <br />b. A Shortage in the Winter Months occurs when Projections indicate that Vallecito <br />will not physically fill to 95,000 AF during the water year. <br /> <br />2.L. Storage Water - Water physically stored in Vallecito under any priority, or water <br />released to the Pine River that CDWR considers as storable Vallecito inflow under any <br />priority that counts against Vallecito water rights, i.e. a paper fill of Vallecito. <br /> <br />2.M. Summer Months - May 10 through September 30 <br /> <br />2.N. Winter Months - October 1 through May 9 <br /> <br />2.0. Vallecito Deliveries - The term includes releases from Vallecito to supply <br />downstream water demands based on PRID and/or TRIBAL water agreements, both written <br />and unwritten, or Project delivery obligations for irrigation, domestic and other uses. Vallecito <br />Deliveries do not include Senior Water. <br /> <br />Section 3 <br />Amount of Donated Water Available to CWCS for ISF Use <br /> <br />All obligations of PRID and the TRIBE with regard to the provision of Donated Water <br />hereunder are conditioned by the following. If any of the following situations occur, PRID <br />and/or the TRIBE will notify the CWCB as soon as practicable of both the reduced amount of <br />Donated Water to be provided to the ISF Reach and the duration for such reduced amount: <br />(1) lack of Vallecito functionality for any reason; (2) an inability to fully meet Vallecito <br />Deliveries; (3) a Compact call on the Colorado River which requires releases from Vallecito; <br />or (4) a temporary emergency situation on the Pine River or for one or more of the Pine River <br />ditches that would require PRID to refrain from releasing or delivering water from Vallecito. <br />PRID and/or the TRIBE will notify CWCB of both the amount of the Donated Water to be <br />provided to the CWCB and the duration for the provision of such reduced amount <br /> <br />3.A. Winter Months <br /> <br />1.a. Beginning on October 1 of each year, for the Winter Months, if storage in <br />Vallecito is at the Highest Allowed Physical Winter Water Level or more, PRID and/or <br />the TRIBE shall provide Donated Water at the Measuring Point to CWCB to maintain <br />an amount equal to 50 cfs, or the inflow into Vallecito, whichever is less, to preserve <br /> <br />5 <br />
