Consent Agenda Item 1.i
Case No. 5-06CW050: Application of Ben E. Nichols and Lois M. Nichols

Application Summal'V

This is an amended application to make a conditional water right absolute and to change the point
of diversion of that water right. Applicants seek to change the point of diversion for Spring Ditch to
Anderson Ditch due to natural changes of the course of Plateau Creek over the years. Applicants
also seek to retain the Spring Ditch as the original point of diversion in case the Plateau Creek
changes again in the future. (This application appears to be a request for an alternate point of
diversion). Application does not specify the acreage irrigated under either ditch.

CWCB Appl"Opriation

The CWCB has appropl1ated the following instream flow water right that could be injured by this
application:

C\VCB Stl'eam/Lake Amount Approp, Watershed County
Case No, ( cfs ) Date
5-86CW226 Plateau Creek 16 3/14/86 Colorado River Mesa

Potential for IniUl'V

The Applicant's proposed change of water right may result in an expansion of use that could injure
the Board's instream flow water right on Plateau Creek.

Other Obiectors
As of June 27, 2007, no other statements of opposition to this application were filed.
