<br />Consent Agenda Item l.g <br />Case No. 5-07CW074: Application of John and Charlene Simcox <br /> <br />Application Summal'V <br /> <br />This is an application for ground water rights, change of water rights, approval of a plan for <br />augmentation, and appropriative right of exchange near the Town of Fraser. Applicants seek <br />conditional ground water rights for 8 wells (Dusty Diamond Well Nos. 1-5 and 8-10) with an <br />appropriation date of December 31,2006. The atnount claimed for each well is 15 gpm for in-house <br />domestic uses only. Applicants seek a change of water right for Applicants' interests in the Crooked <br />Creek Ditch No. 1 from irrigation to consumptive use credits for augmentation purposes and/or <br />storage in Simcox Reservoir for release in accordance with the plan for augmentation applied for in <br />this case. Applicants seek approval of a plan for augmentation to replace out-of-priority depletions <br />associated with uses of water from the 8 wells and evaporative losses associated with Simcox <br />Reservoir. The proposed sources of augmentation water are consumptive use credits and releases <br />from Simcox Reservoir. The Applicant's proposed plan for <br />augmentation and exchange may injure the Boat,d's instream flow water rights on Crooked Creek by <br />not replacing out-of-priority depletions in time, place and amount. <br /> <br />Other Obiectors <br />As of June 26, 2007, Young Life also filed a statement of opposition to this application. <br />
