<br />Consent Agenda Item 1.e <br />Case No. 5-07CW061: Application of Diamond S Ranch, Inc. <br /> <br />Application Summar'V <br /> <br />This is an application for numerous sUlface and ground water I1ghts, changes of water rights, storage <br />rights, and approval of a plan for augmentation on the Eagle River in Eagle County (Hollingsworth <br />Ditch, Line Cabin Pond Ditch, Wanen Gulch Ditch, Wanen Dutch Spring, West Sherman Spring <br />and Pipeline, Lake Oleson, Diamond Star Ranch Augmentation Pond and Diamond Star Ranch <br />Headquarter Well). The proposed uses include inlgation, piscatorial, fire protection, wildlife <br />watering, recreational, domestic, commercial and dust suppression. <br /> <br />CWCB Appl"Opriation <br /> <br />The CWCB has appropriated the following instream flow water rights that could be injured by this <br />application: <br /> <br />CWCB Str'eam/Lake Amount Approp, Watershed County <br />Case No, ( cfs) Date <br />5-80CW126 Eagle River 110/45 3/17/S0 Eagle River Eagle <br />5-80CW124 Eagle River 130/50 3/17/S0 Eagle River Eagle <br /> <br />Potential fOl'lniUl'V <br /> <br />The Applicant's proposed plan for augmentation and exchange may injure the Board's instream flow <br />water rights on the Eagle River by not replacing out-of-priority depletions in time, place and amount. <br />The Applicant's proposed changes of water rights may result in an expansion of use that could <br />injure the Board's instream flow water rights on the Eagle River. <br /> <br />Other Obiectors <br />As of June 26, 2007, no other statements of opposition to this application were filed. <br />
