Harold Miskel and GeoffBlakeslee were not present for the vote. <br />The motion was approved unanimously (7-0). <br /> <br />24. Stream and Lake Protection Section - Pretrial Resolution - Case No. 5- <br />04CW151, Application of Copper Mountain, Inc. <br />Tape 2, Track 4 00:05:04 - 00:22:20 <br />Action: A motion was made by Eric Wilkinson and seconded by Don Schwindt to <br />authorize Staff and the Attomey General's Office to enter into a stipulation with <br />Copper Mountain, Inc., which incorporates the proposal set forth in the Board <br />memo for Agenda Item 24, including a no precedent provision, and containing <br />terms and conditions to prevent injury to the Board's ISF water right on Tenmile <br />Creek. The motion was approved unanimously (9-0). <br /> <br />25. Stream and Lake Protection Section - Hat Creek Proposed Water Acquisition <br />Tape 1, Track 1 00:19:37 - 00:43:12 <br />Action: The Colorado Water Trust (CWT), a non-profit organization, offered a donation <br />of a water right for instream flow (ISF) use on Hat Creek in Eagle County. <br />Pursuant to ISF Rule 6b, the Board's consideration of this proposal at this Board <br />meeting initiated the 120-day period for Board review. No fonnal action was <br />taken. This initial presentation of this proposal provided an opportunity to the <br />Board and the public to identify questions or concems that staff or the CWT will <br />address at a subsequent meeting. <br /> <br />26.
