<br />Congressional.Delegation, and on December 19,2000, Public Law 106-549 was passed by
<br />Congress. As discussed above, this Act provides authority for approval of non-project water
<br />carriage contracts within the Mancos Project facilities.
<br />
<br />1.4 Approval Process
<br />
<br />In order to implement non-project water carriage actions proposed under Public Law 106-549
<br />requirements, Reclamation must first:
<br />
<br />1. Develop basis of negotiation (BON) and receive CoII11tJissio~r's approval;
<br />
<br />2. Evaluate the action for potential environmentaleffects'ijs.required by National
<br />Environmental Policy Act (NEP A). NEP A analyses musl-~:g.c1ude implementation
<br />of other federal environmental and resourG,~re~af6(l standat~'~~J;1c1usive of: the
<br />National Historic Preservation Act (NH)?A--SeC'. 106), Cleari:Wat~r Act (CW A),
