Rule Section: ~ 414.3(d) <br /> <br />Comment: For the reasons discussed above, the term "Storage Credit" should be deleted. <br /> <br />This section should more clearly specify that, if all terms of the proposed rule and Interstate Storage <br />Agreement are met, the Secretary will make available the Intentionally Created Unused <br />Apportionment to the Authorized Entity in the Consuming State. <br /> <br />Proposed <br /> <br />Amendment: (d) DELIVERY OF INTENTIONALLY CREATED UNUSED APPORTIONMENT <br />Redemption of storage credits. The Secretary must be satisfied that ALL necessary actions have been <br />taken PURSUANT TO THIS PART AND THE INTERSTATE STORAGE AGREEMENT to <br />develop intentionally created unused apportionment fer redemptieR ef stefage eredits. Once this <br />determination has been made, the Secretary will make available THE REQUESTED AMOUNT OF <br />INTENTIONALL Y CREATED UNUSED APPORTIONMENT TO THE AUTHORIZED ENTITY <br />IN THE CONSUMING STATE a qaantity af Colorado Riyer ',\'ater ta redeem these credits <br />consistent with the BCPA, Article II(B)(6) of the Decree, and all other applicable laws. Intentionally <br />created unused apportionment that is developed by the authorized entity of the Storing State will be <br />made available to the authorized entity of the Consuming State and will not be made available to <br />other contractors or Federal entitlement holders. <br /> <br />* * * <br /> <br />... Rule Section: ~ 414.4 <br /> <br />Comment: The reporting date should be made more flexible. Under Arizona's underground water <br />storage program, annual reports of water storage are not required to be submitted to the Arizona <br />Department of Water Resources.for storage credit calculation until March 31 for the previous year. <br />A.R.S. ~ 45-875.01. It then can take several months for the Department to review and process those <br />reports. The A WBA would be unlikely to have its credit balance for the previous year until July. <br /> <br />The section should specify that only the Authorized Entity in a Storing State need report storage <br />amounts to the Secretary. <br /> <br />The suggestion that water is stored in the Storing State "on behalf of' water users outside that State <br />should be eliminated. <br /> <br />For the reasons discussed above, the term "Storage Credits" should be deleted. <br /> <br />Proposed <br /> <br />Amendment: Reporting requirements and accounting UNDER INTERSTATE STORAGE <br />AGREEMENTS far starage eredits. <br /> <br />Each authorized entity OF A STORING STATE will annually report to the Secretary, BY A DATE <br /> <br />http://www.adwr.state.az.us/annclbankrule.html <br /> <br />3/12/98 <br />
