On the morning of <br /> <br />November 16 Hoover proceeded to present to the Commissioners <br /> <br />a memorandum containing "a series of rough principles upon <br /> <br />which we felt we had secured agreement and which should <br /> <br />comprise the basis of the compact."123 Although subsequently <br />modified and refined, this document did in fact embody the <br />essence of the final Compact. Paragraphs S through 8 of the <br /> <br />November 16 draft closely resembled Paragraphs (a) and (c) <br />through (g) of Article III of the Compact. Paragraph 5 of <br /> <br />the draft stated in part that "appropriations may be made in <br /> <br />either division with equality of right as between them, up to <br /> <br />a total of 7,500,000 acre-feet per annum, for each divi- <br /> <br />sion."124 <br /> <br />This approach solved the conundrum inherent in the <br /> <br />guaranty scheme by abandoning the attempt to allocate the <br /> <br />entire flow of the River. Hoover summarized the new idea: <br /> <br />In our discussions yesterday we got away from <br />the point of view of a fifty-fifty division of the <br />water. We set up an entirely new hypothesis. That <br />was that we make, in effect, a preliminary division <br />pending the revision of this compact. The seven <br />and a half million annual flow of rights are <br />credited to the South, and seven and half million <br />will be credited to the North, and at some future <br />day a revision of the distribution of the remaining <br />water will be made or determined. <br /> <br />An increasing amount of water to one division <br />will carry automatically an increase in the rights <br />of the other basin and therefore it seemed to me <br />that we had met the situation.
