Where D~, contractual <br />changes or assignments of Contracts will be negotiated in an expeditious D18IJDCr, <br />consistent with Federal reclamation law and polley. <br /> <br />B.2 In locations where there is strong interest in transfers of project water or where the future <br />potential of such activities is relatively high and known, Reclamation will seek to <br />encourage all parties to develop innovative ways to reduce transactions costs. <br /> <br />B.3 Transfers will involve both administrative costs and federal charges associated with the <br />project water itse~ <br /> <br />. . <br />. a. In general, the parties must bear all cOsts associated with compliance with federaJ, <br />~ tribal, .and.locallaws and for the administrative costs associated. with the . <br />transfer. <br /> <br />b. Reclamation will seek to. minimi7~ administrative cOsts wherever. paSSlole by only <br />recovering administrative costs necessary to the transaction. . <br /> <br />. c. Subsidies associated with the provision of project wateI' for irrigation purposes wilt. <br />not follow the project water as uses shift &om agricultural to municipal8Dd .. <br />industrial uses (i.e., repayment ~bsidies will not be transferable).. <br /> <br />d. Charges in addition to administrative costs imposed by Reclamation should be <br />~~bthe~mthe~~~ect~'~~~~~~m <br />nonnally allocable storage, delivery, or extra costs incmred by Reclamation. <br /> <br />8.4 Revenues received by Reclamation from transfers of project water shall be credited in <br />accordance with applicable law and policy. The federal government, because it is the <br />owner of the fucilities, shall not be precluded from sharing revenues :from the lease or sale <br />of project water with the hiStoric user of that project water to the extent permitted by law. <br /> <br />8.S Reclamation's approval and inV{))vement in voluntary transfers of project water should <br />not: <br /> <br />a. Obligate the federal government to incur extra non-reimbursable expenses <br />to store project water or convey it to a ~ location. <br />b. Establish any right to future transfers or any other rights beyond those <br />expressly provided for in negotiated agreements. <br />c. Establish any new rights to receive project pumping power at project use <br /> <br />5 <br />
