project, because they contribute to the economy, but there may not be money available to <br />address the ultimate needs of this size of project , which is smaller than a lot of other <br />projects . <br /> <br />Eric Wilkinson : Once SB 179 was passed there was a big push to get criteria out because <br />applications had to be in by January. The IBCC and CWCB did a good job in getting <br />info rmation out, but there probably needs to be more time for parties to prepare <br />app lications and technical assistance available to help them in that process . The CWCB <br />will work to the greatest extent possible to process applications as long as they meet <br />criteria. <br /> <br />Rick Brown continued his presentation by highlighting t wo applications th at were different than <br />others received. One asked for funds for purchase of land for a reservoir site in the Pagosa <br />Springs area. Land prices are going up, and while the reservoir is not needed right now, <br />purchasing the land now will save the city money and allow for future planning. The second <br />application requested funds for pu rchase of ag ricultural water rights for other purposes (Vail <br />Ditch Acquisition in Grand County Area). <br /> <br />Rick’s next task is to revise the a pplication to make it more menu - driven, and add more detail to <br />what is expected of a scope of work , budgets and performance schedules . Each s cope of work <br />should state three things: the purpose of the activity; methodology; and what d eliverable or <br />outcome will come from the activity . This bre akdown s hould be by task , and the detailed <br />budget should also be broken down by task, including information on how unit costs and rates <br />were determined. Applicants need to provide good performance schedules that link tasks to <br />budget. If approved, monies will either be in the form of 1) a contract, or 2) purchase order (the <br />latter if under $100,000 dollars). Contracts require insurance and indemnification provisions. <br /> <br />Questions and comments: <br /> <br />Ray Wright: Was T ABOR an issue for some applicants? Answer (Ri ck Brown): Yes, for <br />some. In some cases there is not an easy exemption, especially if revenue is coming in. <br />Also a non - profit can be used to manage funds. We c ould also have the contractor <br />performing the work be the direct recipient of funds, but there could be an accountability <br />issue there . <br /> <br />Peter Binney : Does the State retain any ownership if hard assets, including water rights <br />that are acquired for one purpose and later transferred to other uses, or land that is <br />acquired as part of an activity ? Answe r (Rick Brown): If land is acquired, and it is not <br />used for purposes defined in the application, moni es must be returned to State. The w ater <br />right acquisition issue is not clear yet. <br /> <br />Dan Birch : I want to thank Rick and complement him on his work. He w as always <br />accessible and available in spite of a heavy work load. <br /> <br />Mike Shim min: Can we get an improved form that let applicants know what they really <br />need? Can you provide Roundtables with a checklist so that they can make sure <br /> 6 <br />
