<br />For the table I’m showing (reference separate presentation) , we used the 1922 date to <br />figure out senior versus junior — net absolute water rights, not considering conditional. If <br />you w ould like to have a copy of these numbers, please e - mail me. <br /> <br />What do we think is necessary to prepare for a call? Continue research and studies, <br />including asking for financial assistance through the General Assembly. When it comes <br />to drafting the rule s, this is something we’ll work on with all of the agencies in the DNR. <br />We will also come out and ask for the public’s help – conservancy and conservation <br />districts, water users, IBCC, constituents who hold water rights , etc . We anticipate lots <br />of work w ith the public, not only to protect the immediate issues and concerns, but the <br />future as well. We like the idea of using the 2025 time horizon, but we have to look <br />beyond that as well. <br /> <br />Eric K uhn: Do you have any thoughts on the interconnection between what you’re doing <br />and the previous study we were talking about? <br /> <br />Ken Knox: I agree that there is a connection. Our foundation is a program we use called <br />Hydro base . We and the CWCB must have the same data to work from – a data centered <br />approach. It is also fair that we bring to you other information that some might not be <br />aware of. For example, reservoir operating procedures and other site - specific rules etc. I <br />think the questions we are asking and the study CWCB will be doing are inextricable and <br />in tertwined. It is not the State Engineer’s role to decide how water should be developed <br />– we’re the regulator. <br /> <br />Peter Binney: The issues, information and the work of the State Engineer and the CWCB <br />are joined at the hip. We need to understand the frequen cy of when a call is going to be <br />made and how we’ll react. An isolated one - day call is much different than an extended <br />call, or something that repeats every year. Is anybody going to look at that side of it? <br /> <br />Eric Kuhn: This gets back to that fundamental issue we’re all asking about – risk. Maybe <br />they’re going to have to make assumptions in the study about how the compact is going <br />to be administered. It is n aïve to think we’ll have storage when a compact call is made, <br />th <br />because it will come in the 11 ye ar of an 11 year drought. All of this has to be <br />interrelated. If we don’t have a good discussion of the risk of your water right being <br />curtailed, the study won’t be as useful. <br /> <br />Jeris Danielson: Would y ou agree that the call you’ll have to administer ag ainst will be <br />at Lee’s Ferry? And would you agree that the administrative scheme you come up with, <br />unless we change our constitution, has to be based on prior appropriation? We talked <br />about this in the late 80’s, during informal meetings with water users . <br /> <br />Ken Knox: Yes, the call we have to administer will most likely be at Lee’s Ferry, but we <br />have to answer the other questions too. I would agree that prior appropriation is our <br />s tarting point. At this point, the State Engineer’s Office would not want t o close the door <br />to looking at options. <br /> 11 <br />
