Compact – The Final Product <br />Importance <br />A key less on from the interstate compact negotiation process is the need to avoid getting <br />bogged down in too much detail. The compact should be simple and direct in its terms. <br />Attempts to go into too much detail can lead to complications that result in failure. <br /> <br />T he final structure and provisions of the compacts will vary. However, there is a need to <br />have some consistency to facilitate implementation. Also valuable lessons can be learned <br />from the structure and provisions of previous compacts. <br /> <br />Ideas/Suggestions <br />? <br /> <br />L eadership will be important in shaping the compact so complications are avoided. <br />? <br /> <br />Facilitators will play a key role in ensuring the level of detail and the shape of a compact <br />is appropriate. <br /> <br />Anticipated Course of Action <br />? <br /> <br />Leadership and facilitators will ste er the negotiators away from too much detail and <br />towards an appropriate structure. <br />? <br /> <br />Example compact structures and provisions can be provided. These can come from <br />international treaties, interstate compacts, and other cross - jurisdictional agreements. <br /> <br /> <br /> <br />12. Enf orcement <br />Importance <br />Once negotiations are complete there needs to be a mechanism for implementing the <br />compact and incorporating it into Colorado’s existing water law. This will require a <br />ratification process with details on how the compact will affect exi sting law and how the <br />compact will be administered. It is also important to ensure that any final agreement <br />cannot be unilaterally altered or abrogated. <br /> <br />Ideas/Suggestions <br />? <br /> <br />Once negotiations are complete the compact will be implemented through a constituti onal <br />amendment (referred). <br />? <br /> <br />The ratification process will be a vote of the citizens. <br />? <br /> <br />How the compact will affect existing law and how it will be administered will be <br />included in the details of the compact. This could vary from compact to compact. <br />? <br /> <br />The compa ct will also need to outline how the terms of the agreement can be changed or <br />amended. <br /> <br />Anticipated Course of Action <br />? <br /> <br />All of the Ideas/Suggestions outlined above will be pursued. <br />8 <br />
