If anything it would make it less expensive. <br /> <br />Something for the Committee to be aware of in checking with <br />David and with Representative Plant I think the next stop is <br />appropriations on this bill if it gets out of this Committee. So any <br />other questions or thoughts for Representative Penry. <br />Representative McKinley. <br /> <br />I still have a problem here. Declared that the policy of the State of <br />Colorado, that all areas the state must cooperate. And then we see <br />it is fi.lrther declared to be the policy of the State of Colorado River <br />basins, sub-basins should negotiate agreements regarding use and <br />we had heard testimony earlier, highest and best use is defined as <br />where the money is, that's where the money is. <br /> <br />Representative McKinley, where are you reading? <br /> <br />On Page 3. It's got regarding, and then we have the two IC used <br />and we had defined highest and best uses for the money, but there's <br />things like lifestyle, cultural and heritage into that also. <br /> <br />We're actually going to put into law something that mandates a <br />policy without superseding or changing any of the courts. We're <br />getting into a lot of the court areas here. When we talk about <br />binding and legal, those are terms that are done by courts. <br /> <br />And then we've given the Executive Director powers here above <br />and beyond what we normally would. So I think we need to do a <br />lot of work and study, nothing wrong with studying, we have to <br />have education, we have to have knowledge to arrive at a decision. <br />But to couple knowledge with law and mandate educational law it <br />kinda goes against what <br /> <br />Representative Penry <br /> <br />The language that you're reading in the nonbinding legislative <br />declaration, I wouldn't, I don't accept your interpretation about <br />highest and best being, you know, sort of flowing to the money. <br />But if you would, you know, that's a nonbinding section of the bill. <br />That's cotton candy, so if you'd like to rewrite that to make it more <br />comfortable, I think that's all right. <br /> <br />And in terms of studying this, you know, we've studied this issue <br />ad nauseam for a very long time.
