If in accomplishing these ends by 'creating instituti()ns~ <br />.society can compensate for any damages that might in any case. be c01ll1'erumblc <br />by law, both law and society ~iill have beILC(ited. <br />Examples. of the kiridsof damages that might result f!'Oin a WaSA pro- <br />gram and that would be compensable on an institutional basis ils a matter of <br />public policy if they are to' be compensable at all are {JoQd damages, calamities, <br />and regional ccon9IillC lossc.~. It would be practIcally impossible. to prove that <br />augmentation al.:tivities were the proximate cause of f1o<)ding,since the amount <br />of snow pack (both natural and augmented) is only onc of 111any factors con- <br />tributing to flooding. The National Flood Insurance Priigram, which Congress <br />h.as established as an instrulllent of a naUOlia! policy and program rehlting to <br />flood damages; shouldbr::givcn serious consideration for integration with the <br />WOSA 'program. The increase in insurance premiums that could be attribut- <br />able to \VOSA programs could be paid fromrevenues frl)lH the.sale of WQSA <br />water. A federal dis.aster prQgram designed to .provide relief for major oatuml <br />disasters is also in t~xistence. ft is suggested that consideration be given to the <br />creation of a special disaster fund if it is determi.ned that cahimitous disasters <br />cao occur with WaSA. This fund coold use revenues g~ncrated by the WOSA <br />prqgram and CQuld be integrated with existing fcderal relief legislation. <br />The key point in any program to compensate for thCitdverse e\:onomic <br />irnp~\cts of a WaSA progrmn is that public pOlicy can apportion n.ct revenues <br />to strengthen the ecortomy of tb~ tatga;:t <ire~s in many different ways.
