<br />0016':J5 <br /> <br />. . <br /> <br />.. <br /> <br />Conclusions <br />There is nothing in P.L. 106-392, the Program document, cooperative agreement enabling the <br />Program, or the Section 7 Principles that restricts the benefits of the Program to any particular <br />party, or applies those benefits on a priority basis to any particular party. <br /> <br />With respect to Indian trust responsibilities of the United States, the Recovery Program provides <br />the mechanism for the federal agencies to meet their trust responsibilities while complying with <br />the Endangered Species Act. The terms of the Recovery Program do not impede the ability of <br />the federal agencies to meet their Indian trust responsibilities. To the contrary, statements are <br />included in the Program document and the "Section 7 Principles" that recognize the federal <br />agencies' trust responsibilities. <br /> <br />Finally, runs of the hydrologic model indicate the Long Hollow project would not adversely <br />impact the flow recommendations. Even if there were some minor impact, the terms of the La <br />Plata River compact must be considered a limitation on the La Plata basin to contribute to those <br />flows. <br /> <br />8 <br />
