PERMIT APPLICATION UNDER SECTION 404
OF THE CLEAN WATER ACT (~3 use 1344)

Summarv of Prooosed Proiect: The U.S. Army Corps of
Engneers (Corps) is requesling public comment on the
following project before the above suspense date. The
application is faT a permlllo place dredged and fill mlilerial
Lo construct a new water diversion structure in and
adjacentlo the Navajo River, and construct a water
pipeline between the new diversion structure and Dulce
Reservoir near Dulce, Rio Arriba County, New Mexico.
The project entails the placing or 46,635 feet of 24 inch
diameter pipe eight feet below grade. The construction will
temporarily impact 1.88 acres of palustrine emergenl
persistent wetlands in the pipeline corridor. A permanent
Intermediate reservoir and pump station will be constructed
from uplands, necessary to reducing pumping expense.

Descrlotion of Work: The proposed water diversion structure atlhe

at a tevel 10 receive water from the Navajo River al most water stages. 11
will contain a screening system to minimize fish entrainmenl and reduce
sediment entering lhe pumps. Rock gabions will be placed over 50 feet of
river bank upstream from the diversion structure to stabilize the riverbank.
A sediment basin will be constructed from uplands adjacent to the pumping
station. The main pump station will be constructed adjacent to Ihe
sediment basin. The pipeline will be buried 8 feet below grade for the
majority of its distance between the diversion structure and Dulce Lake.
The pipeline will be suspended from an existing bridge at thai point where
It crosses Amargo Creek. No discharge of fill will occur in Amargo Creek.
Approximately 1.88 acres of wetland!;> will be temporarily. impacled. dlJrinQ
the construclion of lhe pipeline.

Purnose and Need: The stated purpose or the project is to enable the
Nation to uli1ize their water rights for beneficial uses. The initial purpose of
the projecL is to fill and maintain the pool level of Dulce lake reservoiL
The reservoir was emptied in 1997 when improvements to the dam were
made, and has nol relilled since, due 10 drought. Floodwater relention has
been the only means of capturing and holding water in the reservoir.
Filling of the reservoir is needed as il has historically been used as a
source or irrigalion water and recreation ror the Nalion. Il would also serve
as an emergency backup water supply for Ihe community drinking water
system. The Nation plans to divert up.. to 12l0.00 acre feel of water per year

Related Work: A sediment basin and intermediale reservoir, components
of lhe project will bolh be constructed rrom uplands.

MiliQation Proposed bv the Aoplicanl: The applicant staled that the project
has been designed. emphasizing avoidance and minimization of wetland
impacts. Wetland areas that experience temporary impacls will be
restored and enhanced upon project completion. Restoralion activities will
include site grading to malch pre.construction contours, removal of excess
materials, and revegetation with native wetland species. A secondary
impact of restoring water in Dulce lake is improvement or moisture
conditions down gradient from the lake. Il is anticipated (hat wetland
rormation may also OCGur at the Intermediate reservoir site.
