NOTICE OF PREHEARING CONFERENCE AND DEADLINES <br /> <br />. Pursuant to Rule 12 of the Ru,les Concerning Recreational In-Channel Diversions ("RICD <br />Rules"), Qn March 7, 2002, the City of Colorado Springs, the City of Fountain, the Rocky <br />Ford Ditch Sellers Group, and the City of Aurora requested a hearing on the City of <br />Pueblo RICD application. On March 15,2002, the Director of the Colorado Water <br />Conservation Board ("Board") designated Felicity Hannay as the Hearitlg Coordinator f?r <br />this proceeding. In consultation with the Applicant, the hearing has been set for July 21, <br />2002, in Pueblo, Colorado. Further det~ils on time and location will be provided. <br /> <br />Pursuant to RICD Rule 13, the Hearing Coordinator hereby establishes the following <br />deadlines for written submissions and designation of witnesses and exhibits, and the date <br />of the prehearing conference. Please note that due to the compressed time frame, the <br />Board, the Board's Staff, and the parties must receive documents by no later than 4:45 <br />p.m. on the day that they are due. <br /> <br />May 22, 2002: Applicant's prehearing statement is due. Pursuant to RICD Rille B.d, <br />the prehearing statement shall include: I) a list of all factual and legal issues the <br />Applicant intends to raise at the hearing; 2) a list identifying all of the witnesses that will <br />testify for the Applicant, and a summary of the testimony that those witnesses will <br />provide; and 3) copies of exhibits that the Applicant will introduce at the hearing. <br /> <br />June 5, 2002: Prehearing statements of all other Parties, not including Staff, are due. <br />Pursuant to RICD Rule 13.d, the preheating statements shall include: 1) a list of all <br />disputed factual and legal issues; 2) the position of the Party regardmg the disputed <br />factual and legal issues; 3) a list identifying all of the witnesses that will testify for the <br />Party, and -a summary of the testimony thatthose witnesses will provide; and 4) copies of <br />all exhibits that the Party will introduce at the hearing. <br /> <br />June 17, 2002: Staff's prehearing statement is due and shall include all of the elements <br />listed for the parties' prehearing statements. Staff s prehearing statement may also <br />include a recommendation for action by the Board. <br /> <br />June 21, 2002: Prehearing conference will be held at 1:30 p.m. at 1525 Sherman Street, <br />Room 610, Denver,.
