<br />Revised 1/03 <br /> <br />INSTRUCTIONS TO BIDDER(s) (NOT APPLICABLE FOR 2003) <br /> <br />These instructions constitute a part of the CONTRACT DOCUMENTS and are given for the purpose of <br />guiding BIDDER in properly preparing the BID. Each BIDDER shall prepare the BID in strict <br />compliance with all of the requirements ofthe CONTRACT DOCUMENTS and in accordance with the <br />following instructions: <br /> <br />201 BID. Each BID must be made on the form provided in this bound copy of the CONTRACT <br />DOCUMENTS, all of which documents must be returned at time of BID, ori2:inally bound, <br />in 2:ood order therewith. BID must be enclosed in a sealed envelope, addressed to the OWNER, <br />showing on the face thereof the name of the BIDDER and the PROJECT. <br /> <br />202 QUALIFICATIONS OF BIDDER. If at the option of the OWNER the BIDDER is required to <br />demonstrate BIDDER's qualifications for the PROJECT, then BIDDER must be prepared to <br />submit, within five days of the OWNER's request, written evidence such as financial data, <br />previous experience and evidence of authority to conduct business in the jurisdiction where the <br />PROJECT is located. <br /> <br />203 FILLING IN AND SIGNING BID. BID shall be legibly written in ink and must cover all of the <br />items of WORK called for therein and no others. All of the blank spaces in the BID must be <br />properly filled out. BIDDER must sign the BID with BIDDER's usual signature and shall give a <br />complete business address. BID(s) by corporations shall be signed with the name ofthe <br />corporation followed by the signatures and designations of the President and Secretary (or other <br />person authorized to bind it in the matter) and shall have the corporate seal affixed thereto. <br /> <br />204 ADDENDA. BIDDER is required to acknowledge the receipt of all ADDENDA on the BID, in <br />the place provided, and include it with the BID. <br /> <br />205 ACCEPTABILITY OF BID. No BID shall be accepted from and no CONTRACT will be <br />awarded to any person, firm or corporation that is in arrears to the OWNER, upon any debt or <br />CONTRACT or that is a defaulter, as surety or otherwise, upon any obligation to the OWNER, <br />or that is deemed irresponsible or unreliable by the OWNER or PROJECT co-sponsors as <br />defined in the CONTRACT DOCUMENTS. <br /> <br />206 INFORMAL AND UNBALANCED BID. Any alteration, insertion or erasure by the BIDDER <br />in the form of the CONTRACT DOCUMENTS as originally prepared by the ENGINEER or <br />OWNER and attached hereto shall render the accompanying BID informal and may constitute <br />cause for rejection. Any BID that, in the opinion of the OWNER, is unbalanced so that each <br />item does not reasonably carry its own proportion of cost or that contains inadequate or <br />unreasonable prices for any item may be rejected. <br /> <br />207 ONLY ONE BID ACCEPTED. The OWNER will accept only one (1) BID for the same WORK <br />from anyone BIDDER. This includes BID(s) that may be submitted under different names by <br />one firm or corporation. <br /> <br />208 BID GU/\RANTEE. Each BID shall, as a guarantee of good faith on the part of the BIDDER, <br />be accompanied by a BID GUAR.\NTEE consisting of either a certified or cashier's check made <br />payable without condition to the order oftlle O\\'NER or of a BID BOND written by ~my <br />approvcd corporate surety in favor o[tho OWNER, in ~ln amount stated in tho "INVITATION <br />m~~The-B.fD BOND Fonn-ffi€-lu4ed-itt-S€C-+iBH-400 may bc llsed.
