Permanent stmctures are put in to deflect water to create a recreational <br />boating parle Since 2001 every water right for RICD has been litigated; legislature is <br />trying to clarify the bill so the process is not as expensive for the applicant, the state or <br />objectors. So 2006: the bill that is proposed is a compromise bill fi-om interim <br />committee. <br />How to approve it: the bill changes role that CWCB has in evaluating these applications <br />before going to water court; provides input to water comt along with applicant; limits <br />CWCB to historical role for focus on developing water; does it promote maximum <br />development of water rights in state? takes out the word "minimum": re: minimum <br />amount of water needed. Trade off. . . restriction in administration: if the call cannot <br />produce at least 90% of the amount, the call would not be exercised. This constraint <br />applies an incentive for a call of a reasonable amount of water right. <br />New bill: Recreation defined only as kayaking; previously all kinds of boating allowed. <br />Time of year and time of day: April- Sept; only during daylight hours unless specifics <br />added to decree. <br />Unchanged by this legislation: 2001 legislation limits those who can apply for and hold <br />RICDS to public entities: cities, counties and water districts, water and sanitation districts <br />(analogous to the fact that the State is the only one that can hold water right for in stream <br />diversion) <br />Definition of control stmcture: must be designed by a professional engineer. <br />Debate over SB 37 first in Senate then in House...see what happens. <br />Others: <br />Water quality bill and water quantification process; AK valley; similar bills in previous <br />years. <br />Money bills; one that would provide money for roundtable process. <br />Native species conservation species: helps state pro actively keep species in decline to <br />keep them off of the federal list.
