Will the acquisition of additional water rights be necessary? YES X NO

If YES, please explain.

All FL Gill H20 LLC owners are shareholders in the Johnson and Edwards Ditch Company. A third source
of recharge water planned will be a surface diversion right to be diverted and delivered via the
Prewitt Inlet Diversion and Canal. In addition to recharge, FL Gill H20 LLC is purchasing one
share of Jackson Lake water to add to 15 shares of Morgan Prewitt and 13 Private Rights of
Riverside reservoir water currently held by the owners of FL Gill H20 LLC. Another facet of
the FL Gill H20 LLC augmentation effort will be to get one or more of our existing irrigation
wells designated as an augmentation welles) in order to address timing issues in our collective
out-of-priority depletion hydro graph that cannot be fully addressed using either surface storage
water or recharge credits.

7.
