<br />A enc Name <br />A enc Number <br />Contract Routing Number <br /> <br />Colorado Water Conservation Board <br />PDA <br />DO f,)A 0001<"/ <br /> <br />FIRST AMENDMENT TO <br />INTERAGENCY AGREEMENT <br /> <br />TIDS First Amendment, made this1.oJA. day of September 1999, by and between the State of Colorado <br />for the use and benefit of the Department of Natural Resources, Colorado Water Conservation Board <br />hereinafter referred to as (CWCB), and the Colorado State Board of Agriculture acting by and <br />through Colorado State University, hereinafter referred to as (CSU). <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise <br />made available and a sufficient uncommitted balance thereof remains available for encumbering and <br />subsequent payment of this futeragency Agreement under Encumbrance Number C 153866Ain Fund <br />Number 100, Appropriation Account SEV, and Organization Number VYYY; and <br /> <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with <br />appropriate agencies; and <br /> <br />WHEREAS, the CWCB and CSU entered into an futeragency Agreement on April 27, 1999, <br />Contract Encumbrance No. C153866, hereinafter referred to as the Original Agreement and <br />incorporated herein by reference, wherein the CWCB agreed to participate in and partially fund a <br />water quality and efficiency Demonstration Project during Fiscal Year 1999 in the amount of <br />$20,000; and <br /> <br />WHEREAS, CSU submitted a proposal to conduct Phase II of the Demonstration Project to the <br />CWCB entitled "Demonstration of Best Management Practices to hnprove Crop Yields, Returns and <br />Water Quality in the Arkansas River Valley of Colorado" ("Demonstration Project - Phase IT') <br />(attached hereto as Exhibit A) to be implemented during Fiscal Year 2000; and <br /> <br />WHEREAS, pursuant to Part XN(7)(B) of Senate Bill 99-215, the CWCB is authorized to fund <br />water resource planning and water efficiency demonstration projects at the local level during Fiscal <br />Year 2000 in an amount of up to $275,000 from the Severance Tax Trust Fund Operational Account <br />(STTFOA) created by ~ 39-29-109(1)(a), as amended; and <br /> <br />WHEREAS, the CWCB approved the expenditure of an additional $45,000 from the STfFOA to <br />participate in Phase II of the Demonstration Project at its March 10-11 1998 Board meeting; and <br /> <br />WHEREAS, the CWCB and CSU have agreed to amend the Original Agreement to include the <br />Phase II work items, increase the time for performance by one year, and increase the funding by an <br />additional $45,000 thereby bringing the total cost of the CSU portion of the Demonstration Project <br />to $65,000. <br /> <br />Page 1 of 3 <br />
