First, Tom Williamsen finalized his analysis of the potential firm annual yield
of Eagle Park Reservoir and Robinson Lake. The report concludes that the overall
project is viable and up to a total of 5000 acre feet can be developed at these two
reservoir sites.

Second, the Board of Directors of the Colorado River Water Conservation District
agreed at their July 17 meeting to allow a portion of their decrees for the Red Cliff
(Iron Mountain Reservoir) and Wolcott Projt:-:ts to be exchanged up to Eagle Park
Reservoir/RobinsOl~ Lake to firm up a portion of the project yield. The Board further
agreed to subordinate the remainder of these decrees to the Eagle Park Reservoir
Project. The Board delegated authority to the River District's general counsel to
negotiate the details of this arrangement in a water agreement with the Vail
Consortium.

Our meeting with the Climax Mine representatives went well. It is amazing to me to
see the reclamation of Eagle Park. The mine continues to operate two 10 hours shifts
per day, seven days per week, in hopes that the reclamation will be complete by the end
of October.

John, please feel free to call me at any time regarding the status of this project. We
appreciate your putting a $4 million line item in the Colorado Water Conservation
Board's 1996 budget. Either Glenn Porzak or I will be in contact with you in the very
near future.

Again, thanks.

(~~J~

Rick Sackbauer ~
Chairman

FS:kd

cc:

Glenn Porzak

CONSERVE'
