Construction is <br />expected to begin October 2004 and to be completed in phases during 2004 and 2005. <br />Permitting <br />All easements and rights of way have been secured. The Company expects to be exempt from <br />404 permitting by Statutory exemption, 33 CFR Section 323.4(a) 3. This will be confirmed with <br />the Army Corps of Engineers. <br />Institutional Considerations <br />Entities that are, or may be, involved in the design, construction, and financing of the project <br />include: <br />• Mancos Valley Beaver Ditch Company; financing, construction and project management. <br />• Natural Resources Conservation Service (NRCS); 75% cost share, design, construction <br />supervision and inspection. <br />Page 7 of 15 pages <br />
