1991, ODFtC has proceeded incrementally with plans to store the final 971 acre-feet of the
conditional storage right. These steps have included geotechnical investigations of the auxiliary dilce,
completion of a site specific flood precipitation study and a flood hydrology report which is in
profPress. These efforts have been directly funded by the ODFtC with some assistance from the
Colorado River Water Conservancy District. If a restoration project capable of storing the remaining
conditional water right is not concluded within the near future, there is a looming eventual certainty
that the water right will be abandoned.

PROJECT SPONSOR:

The ODFtC is a mutual ditch company and a non-profit corporation registered in the State of
Colorado. There are 120 shareholders and 10,000 shares of stock The ODFtC has the power to set
annual assessments to be paid by the shareholders, the authority to cut offwater deliveries to
shareholders that fail to pay their assessments, and the power to offer stoclc for sale to pay baclc
assessments. The ODFtC Articles of Incorporation and By-Laws are included in Appendix A.

PROJECT SERVICE AREA AND FACILITIES:

The ODFtC provides irrigation water to an area that encompasses about 20 sq mi and has the ability
to provide water to a large area of about 450 sq mi which extends from Paonia Fteservoir on the east
to Orchard City on the west, north of the North Forlc ofthe Gunnison River. Irrigated acreage within
the service area is primarily used for pasture, and crops such as hay, fPrains, corn and fruit. Primary
facilities include the 6,200 acre-foot capacity Overland Fteservoir and about 28 miles of transmission
ditch and stream channel. Maps of the facility locations and service area are included in appendix F.

HYDROLOGY AND WATER RIGHTS:

The sources of water for the company include Leroux Creelc, Ftoatcap Gulch, Terror Creelc, Hubbard
Creelc, Elk Creelc and Cow Creek Overland reservoir is located on and fed by Cow Creek The
shareholders ofODFtC hold 7 direct flow rights with adjudication dates ranging from 1908 to1954
and total direct flow rights of214.7 cubic ft/sec. They also hold 4 storage rights with adjudication
dates ranging from 1914 to 1954 totaling 7,171 acre-feet. A list of the water rights are included in
Appendix B. Copies of the legal documents for the Overland Fteservoir storage rights are also
included in Appendix B

The most recent yield analysis of the Overland Fteservoir drainage basin was perfoIlIled as part of a
loan application feasibility report in 1976. The actual reservoir operation study results could not be
located. However, the following table of estimated runoffto the reservoir was talcen from this study:
