CHANGES Page 2 of 6 CLIENT and WMCI recognize that it may be necessary to modify the scope of &ERVICES, the schedule, and/or the cost estimate proposed in this Agreement. WMCI shall notify CLI~NT in a timely manner when it has reason to believe a change to the Agreementis warranted and shall! prepare a Change Order request outlining,the required changes to the scope, schedule, and/or cost of the project. CLIENT has a duty to investigate or consider the Change Order request and advise WMCI in ~ timely manner in writing on how to proceed. If the Change Order request does not affect the originall scope of work, and the . I CLIENT does not believe that the change order is necessary, WMCI will continu~ with the Scope of Work given in Attachment A. . 6. DATA AND INFORMATION CLIENT shall provide to WMCI all existing reports, data, studies, plans, spec~cations, documents and other information which are relevant to the SERVICES. WMCI shall be entitled! to rely upon the existing reports, data, studies, plans, specifications, documents and other information I provided by CLIENT or others. in performing the SERVICES, and WMCI assumes no responsibility or Ii,bility for the accuracy or completeness of such, except those which were prepared or performed by W~CI, its subcontractors, or others under the direction or oontrol of WMCI. . 7. PROFESSIONAL WORK PRODUCT All documents, including but not limited to, reports, plans, designs, boring log$, field data, field notes, laboratory test data, calculations, and estimates (the "Documents") and all elec~ronic media prepared by WMCI are oonsidered its professional work product. The client shall receive! all originals of the work prOduct. WMCI shall have the right to retain copies of the Documents. WMC:I shall not be responsible for reuse ormisuse of its professional work product by CLIENT or others. I 8. INSURANCE AND INDEMNITY WMCI maintains and shall oontinue to maintain during the performance of this Agreement its standard insurance ooverage as follows: . Employers' liability with the following limits: Each Accident $1,000,000 Workers' Compensation insurance in compliance with statutorY limits I I I I . . Business Automobile Liability with the following limits: Combined Single Limit $1,000,000 . Commercial General Liability with the following limits: Each Occurrence $1,000,000 General Aggregate $2,000,000 Professional Liability Insurance with the following limits: Any One Claim $1,500,000 Policy Aggregate $1,500,000 . .
